USTR opens public comment period on proposed actions against Brazil
In Washington, the United States Trade Representative determined under Section 301 of the Trade Act of 1974 that certain of Brazil’s acts, policies, and practices related to digital trade and electronic payment services; unfair, preferential tariffs; anti-corruption enforcement; intellectual property protection; ethanol market access; and illegal deforestation are unreasonable and burden or restrict U.S. commerce, and are thus actionable under Section 301(b) of the Trade Act.
As a result of this determination, the U.S. Trade Representative has proposed responsive action for public comment, while the United States continues to engage intensively with Brazil to seek resolution of U.S. concerns. To be assured of consideration, interested persons should submit requests to appear at the hearing, along with a summary of the testimony, by June 22, 2026.
Written comments are due by July 1, 2026. USTR will hold a hearing about the proposed action on July 6, 2026.
