Second North Dakota judge says SCS CO2 pipeline permits unconstitutional

In North Dakota, Successful Farming reports a South Central Judicial District Judge has reversed the permits for Summit Carbon Solutions’ carbon dioxide pipeline given by the North Dakota Industrial Commission because he says parts of the laws under which the permit was approved are unconstitutional. The ruling is in line with a similar one by a Northeast Judicial District Judge in December. In both cases, groups representing landowners and landowner rights brought the suits against SCS for seeking to put the pipeline under land where landowners didn’t consent.
