Brazil holds virtual public hearing regarding biodiesel rule shifts

October 28, 2026 |

In Brazil, the government held a public hearing online to receive contributions on draft resolution that amends two resolutions of the ANP related to biodiesel and the shipment of data of the agents regulated to the ANP.

The objective of the review is to implement legal obligations related to the proof, by fuel distributors, stocks and purchases of biodiesel compatible with the volume of diesel oil B marketed, expanding the control over compliance with the mandatory mixture of biodiesel to diesel.

ANP Resolutions No. 857/2021, and No. 729/2018, will be amended. The first establishes the rules for the commercialization of biodiesel to meet the mandatory addition of this biofuel to the diesel oil sold to the final consumer, while the second provides for the procedures for sending information to the ANP by the regulated agents.

The changes stem from Law No. 15.082/2024, which included art. 68-G in Law No. 9,478/1997 (Oiler Law), and its regulation by Decree No. 12.437/2025. The draft under discussion was prepared after the realization of Regulatory Impact Analysis (AIR) by the ANP, between 2025 and 2026.
