RFA files two challenges against EPA in US Court of Appeals over SREs

In Washington, DTN reports the Renewable Fuels Association has filed two challenges in the U.S. Court of Appeals for the D.C. Circuit against EPA’s latest small-refinery exemptions under the Renewable Fuel Standard. EPA granted 29 exemptions covering 1.76 billion gallons on Aug. 31, 2026, after granting exemptions totaling 160 million RINs for 2023 and 2024. RFA argues the decisions rely on flawed economic analysis and says EPA’s own market analysis has historically found that RIN costs are passed through to wholesale fuel buyers. EPA has shifted to case-by-case assessments that can produce full, partial or no exemptions based on refinery-specific economic factors.
