South Dakota and North Dakota legislatures tackling pipeline regulation

January 28, 2025 |

In South Dakota, the South Dakota Searchlight reports the state’s House of Representatives passed a bill banning the use of eminent domain for carbon pipelines, which will now move onto the Senate for a vote. The House passed the bill in a 49-19 split. The House Speaker Pro Tempore was the author of the vote and lives near the planned Summit Carbon Solutions pipeline. She said the bill doesn’t ban pipelines in the state but removes the “superpower” of eminent domain from those developing pipelines. Meanwhile, in North Dakota, hearings are set for a number of bills related to carbon pipeline regulations, including regarding eminent domain amongst other topics.
