Landowners against Summit Carbon Solution’s pipeline seek reconsideration of latest court ruling

January 6, 2026 |

In Iowa, the Iowa Capital Dispatch newspaper reports that landowners who have been fighting against Summit Carbon Solution’s carbon sequestration pipeline and their attempts to use iminent domain to secure the land required for the project have filed a motion for reconsideration with the Polk County District Court regarding its ruling in December. That ruling put on hold a current case against the pipeline’s permit until the Iowa Utilities Commission ruled on proposed amendments to the permit, as the company requested, but the landowners say that decision relied heavily on what the judge referred to as “South Dakota’s CO2 Pipeline Ban” when they argue the law isn’t a ban and the project could still go through. They are seeking an appeal of the permit but can not get such an appeal started if the permit remains in limbo.
