Germany cuts biomethane tender volume

In Germany, the tender volume for the bidding deadline of April 1, 2025 is reduced by the Federal Network Agency because it is expected that the tendered volume will be larger than the submitted bid volume (imminent signature).

The new tender volume is 26,032 kilowatts. The “Act amending the Renewable Energy Sources Act to make biogas plants more flexible and ensure follow-up funding” entered into force on February 25, 2025. With the exception of Section 39i (1) Sentence 1 EEG and Section 39k (3) EEG, the application of the changes introduced by this Act regarding the tendering procedures for biomethane plants requires the approval of the European Commission under state aid law.

The changes may only be applied after the European Commission has granted state aid approval and only subject to this approval. If the state aid approval is granted by the bid deadline, we will inform you on this page. Until the European Commission grants the required state aid approval, the provisions of the Renewable Energy Sources Act (EEG) in the version valid on February 24, 2025, apply (Section 101 (2) Sentence 2 EEG).

If state aid approval is not granted by March 31, 2025, the provisions of the EEG in the version valid on February 24, 2025, i.e. the provisions under the old legal situation, will apply to the bidding deadline.
If state aid approval is granted on March 31, 2025, bidders will still have the opportunity to respond to the application of the new legal situation by withdrawing a bid and, if necessary, submitting a new bid on April 1, 2025. Alternatively, bidders can submit two different bids for the same plant, provided one of the two bids is withdrawn by midnight on April 1, 2025.
Please note that two bids from the same bidder must be marked as different bids by specifying different bid numbers. Withdrawals must be declared for a specific bid (by specifying the bidder and the bid number) and using the provided form. A security provided must be clearly attributable to the individual bid.
